Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Nubian Dukes mobile application, website, and related services (collectively, the "Service"), operated by Nubian Dukes, LLC, a Wyoming limited liability company ("Nubian Dukes," "Company," "we," "us," or "our").

By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must not access or use the Service.

1. Eligibility and Age Verification

You must be at least 18 years of age to access or use the Service. By creating an account, you represent and warrant that all information you provide is truthful and accurate.

Nubian Dukes reserves the right to request age verification and to suspend or permanently terminate accounts found to have misrepresented age or identity. Any misrepresentation may result in immediate termination without refund and potential reporting to authorities where required.

2. Account Registration

To access certain features, you must create an account. You agree to:

- Provide accurate, current, and complete information

- Maintain and promptly update your information

- Maintain the confidentiality of your login credentials

You are solely responsible for all activities that occur under your account.

3. Community Guidelines and User Conduct

Nubian Dukes is a social networking and dating platform intended for respectful interaction. You agree not to:

- Use the Service for unlawful purposes

- Harass, threaten, abuse, defame, or harm others

- Post or transmit content that is obscene, hateful, discriminatory, or exploitative

- Impersonate any person or entity

- Solicit personal, financial, or sensitive information from other users

- Upload viruses, malware, or other harmful code

ZERO TOLERANCE POLICIES

The following behaviors are strictly prohibited and will result in immediate account termination without warning:

• SEXUAL CONTENT INVOLVING MINORS — Any content, messages, or behavior involving or targeting anyone under 18 years of age is strictly prohibited. Such violations will be immediately reported to law enforcement authorities including the National Center for Missing & Exploited Children (NCMEC).

• THREATS OF VIOLENCE — Any threats to harm, attack, kill, or injure any person will result in immediate termination and may be reported to law enforcement.

• HATE SPEECH — Racism, sexism, homophobia, transphobia, or any discriminatory language targeting protected groups is not tolerated.

• HARASSMENT OR BULLYING — Repeated unwanted contact, intimidation, or targeted abuse of other users.

• BLACKMAIL OR EXTORTION — Threatening to share private content or information for any purpose.

We reserve the right to remove content or terminate accounts that violate these Terms.

4. User Content

You retain ownership of content you post ("User Content"). By posting User Content, you grant Nubian Dukes a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, reproduce, modify, display, distribute, and create derivative works from such content for purposes of operating, promoting, and improving the Service.

You represent that you own or have the necessary rights to all User Content you submit.

5. Prohibited Content, Sexual Conduct, and Moderation

You may not upload, post, or share content that:

- Is pornographic, sexually explicit, or depicts graphic sexual acts

- Contains nudity intended for sexual arousal

- Involves or depicts minors in any manner

- Is non-consensual, exploitative, or promotes sexual violence

- Promotes prostitution, trafficking, or illegal sexual activity

Automated and Human Moderation

To enforce these Terms and protect users, Nubian Dukes employs a combination of:

• Automated content filtering that scans text for offensive language, hate speech, and prohibited content

• Artificial intelligence tools for image moderation

• Human moderation team that reviews all user reports within 24 hours

Our moderation system automatically detects and blocks:

• Offensive words and slurs

• Hate speech patterns

• Content suggesting involvement with minors

• Threats of violence

• Scam and spam patterns

Users who violate content policies receive the following escalating enforcement:

• First offense: Warning (for minor violations)

• Second offense: Temporary suspension

• Third offense: Permanent ban

• CRITICAL VIOLATIONS (minors, threats, exploitation): Immediate permanent ban and law enforcement notification

Nubian Dukes maintains a zero-tolerance policy for sexual exploitation, abuse, or non-consensual conduct. Any violation may result in immediate account termination and reporting to appropriate authorities.

6. Paid Services and Subscriptions

Certain features of the Service may be offered on a subscription basis and billed through Apple App Store or Google Play.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You may manage or cancel subscriptions at any time through your Apple ID or Google Play account settings.

All payments are non-refundable except as required by applicable law or platform policies. Nubian Dukes does not control refunds issued by Apple or Google.

Apple App Store EULA Notice: If you access the Service via Apple iOS, you acknowledge that this Agreement is between you and Nubian Dukes, LLC only, and not Apple Inc. Apple is not responsible for the Service or its content. In the event of any conflict between these Terms and Apple's Licensed Application End User License Agreement ("Apple EULA"), the Apple EULA shall control to the extent required by Apple's App Store Review Guidelines.

7. Account Termination, Safety, Reporting, and Transparency

Safety and Reporting

User safety is our highest priority. Nubian Dukes provides comprehensive safety tools:

• REPORT USERS — Tap the flag icon on any profile, photo, or message to report violations. Report categories include harassment, hate speech, sexual content involving minors, spam/scams, threats, impersonation, and more.

• BLOCK USERS — Tap the block icon on any profile to immediately prevent that user from contacting you or viewing your profile. Blocking automatically flags the user for moderation review.

• MODERATION SLA — All reports are reviewed by our moderation team and actioned within 24 hours. Critical reports (minors, threats, violence) are escalated for immediate review.

If you believe a user poses an imminent threat or is engaging in illegal activity, you should contact local law enforcement immediately.

Trust & Safety Transparency

Nubian Dukes may publish periodic Trust & Safety transparency reports summarizing enforcement actions, content moderation trends, and policy updates in anonymized and aggregated form. These reports are provided for informational purposes only and do not create any legal obligation.

Account Termination

We may suspend or terminate your account at any time, with or without notice, for violations of these Terms, Community Guidelines, or conduct that poses a risk to other users or the Service.

8. Intellectual Property

All trademarks, logos, software, and proprietary content associated with the Service are owned by or licensed to Nubian Dukes, LLC. You may not copy, modify, distribute, or exploit any portion of the Service without prior written consent.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUBIAN DUKES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Nubian Dukes, LLC from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

13. Mandatory Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if eligible.

Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Wyoming, unless otherwise required by applicable law.

You agree that disputes will be resolved only on an individual basis and that you waive any right to participate in a class action, class arbitration, or representative proceeding.

14. DMCA Copyright Policy

We respect intellectual property rights. If you believe content infringes your copyright, submit a notice including:

1. Identification of the copyrighted work

2. Identification of infringing material

3. Your contact information

4. A statement of good faith belief

5. A statement under penalty of perjury

6. Your physical or electronic signature
